Syracuse University assistant coach Bernie Fine won’t face state charges despite the fact a county district attorney found two of the alleged victims and former Syracuse ballboys to be credible. Regardless of the facts, the decades-old charges stand outside the statute of limitations.

“It is not my place to pronounce Bernie Fine guilty of anything,” Onondaga County District Attorney William Fitzpatrick said. But new allegations from a third man, Zach Tomaselli of Maine, are being investigated by the US Secret Service.

For Fine’s part, the 65-year-old coach, who was recently let go by the university, maintains he’s innocent of all charges. However, there are questions about whether Tomaselli’s story holds up.
